Terms of Use

These Terms may be translated into other languages for user convenience. In the event of any inconsistency or conflict between the English version and a translated version, the English version shall prevail.

1. Service Provider

AskHedgy is a software-as-a-service (SaaS) platform operated by Andrey Pogorelov, an individual conducting registered individual activity in Lithuania under an Individual Activity Certificate (Individualios veiklos pažymos Nr. 335363), operating under the name “AskHedgy”.

For the purposes of these Terms, “AskHedgy”, “we”, “us”, and “our” refer to the service provider described above.

2. Definitions

For the purposes of these Terms:

  • Service means the AskHedgy SaaS platform and all related features, tools, and functionalities.
  • Customer means any business or professional user who creates an account and uses the Service.
  • Review Kit means a set that a Customer creates in the Service, for example for a location, service, or event. A Review Kit includes a Survey, a QR code, printable materials, a public link, an optional link to the Customer’s Google review page, and related settings and analytics.
  • Survey means the questions within a Review Kit that Respondents answer.
  • Respondent means any end-user who opens a Review Kit through its QR code or public link and answers its Survey.

3. Acceptance of Terms

By accessing or using AskHedgy, you agree to be bound by these Terms and applicable laws. If you do not agree, you must not use the Service.

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.

4. Description of the Service

AskHedgy is a SaaS platform that enables businesses to create Review Kits. Through a Review Kit, respondents answer a short anonymous Survey opened by QR code or public link and are invited to visit the business’s Google review page. The business receives notifications of low ratings and can analyze responses.

The Service includes creation of Review Kits and Surveys, generation of QR codes, printable materials and public links, response collection, a link to Google reviews, email notifications, analytics, automated question suggestions, Insight Questions, and incentive mechanisms.

We may modify, update, or discontinue any part of the Service at any time. The Service is provided on an “as is” and “as available” basis.

5. Business Use Only

The Service is intended exclusively for business and professional use. You confirm that you are not using AskHedgy as a consumer.

To the fullest extent permitted by applicable law, consumer protection regulations do not apply to your use of the Service.

6. Account Registration & Security

You are responsible for providing accurate account information and maintaining the security of your credentials.

You are fully responsible for all activities performed under your account.

7. User Responsibilities

You are responsible for all content created, uploaded, or distributed through the Service, including Review Kits, Surveys, questions, QR codes, links, and related materials.

You agree to comply with all applicable laws, including data protection laws such as the General Data Protection Regulation.

You must ensure that you have a lawful basis for collecting and processing any personal data through the Service.

You must not use the Service to collect special categories of personal data, such as health data, and must not add questions that ask Respondents for such data.

You must not misuse the Service, interfere with its operation, or violate applicable laws or third-party rights.

8. QR Codes, Links & Review Requests

QR codes and public links generated via AskHedgy must be used lawfully and with appropriate authorization.

You must not:

  • place QR codes on third-party property without permission
  • modify or misuse QR codes or public links
  • use QR codes or public links in misleading or deceptive contexts
  • redirect QR codes or public links outside the intended use of the Service
  • use QR codes or public links in a way that could cause harm or reputational damage

Sharing links. You may share a Review Kit’s public link with your customers through your own channels, such as email, text messages, or messaging apps. AskHedgy does not send messages to your customers and does not receive their contact details. You are solely responsible for having any required consent and for complying with applicable laws on electronic communications, direct marketing, and spam, including the GDPR, ePrivacy rules, the U.S. CAN-SPAM Act, and the U.S. Telephone Consumer Protection Act (TCPA), where they apply to you.

Real customers only. You must share QR codes and links only with people who have actually used your business.

No selective requests. You must not show QR codes or send links only to customers you expect to be satisfied, choose who receives them based on ratings already given, or discourage customers from leaving negative reviews.

You are solely responsible for distribution and usage of QR codes and public links.

9. Anonymous Responses Disclaimer

The Service supports anonymous response collection, but we do not guarantee absolute anonymity.

Anonymity may depend on configuration, technical factors, and end-user behavior. You are responsible for how anonymity is presented to respondents.

10. Data Protection

AskHedgy processes data in accordance with applicable laws, including the General Data Protection Regulation.

You act as the data controller for personal data collected via your Review Kits. AskHedgy acts as a data processor under applicable data protection law when processing survey data on your behalf.

You are responsible for ensuring lawful processing of personal data and providing appropriate notices to end users.

By agreeing to these Terms, you also agree to the data processing terms outlined in our Privacy Policy.

We process personal data only on your documented instructions, except where required otherwise by applicable law.

11. Service Features & Limitations

The Service provides tools for creating Review Kits and Surveys, generating QR codes and public links, collecting feedback, and analytics.

Insight Questions, automated question templates, and analytics outputs are provided for informational purposes only and do not constitute professional or business advice.

We reserve the right, at our sole discretion, to modify, update, or remove questions from the Insight Questions library at any time without prior notice.

We do not guarantee any specific business outcomes, including revenue growth, number of reviews, Google rating, customer satisfaction, or performance improvements.

Google reviews. The Service may display to respondents a link to your business’s Google review page. AskHedgy is not affiliated with Google LLC and does not control Google. The publication, moderation, and removal of reviews, as well as any action concerning your business profile, are determined solely by Google. We do not guarantee that a respondent will leave a review, or that any review will be published or remain available. The Service records only the fact that the link was clicked and does not receive any information about reviews.

Notifications. Low-rating notifications are sent by email. We do not guarantee their timely delivery, including in the event of delays or filtering by email service providers.

12. Response Booster (Rewards)

The Service may allow you to offer rewards or incentives to respondents.

Rewards may be offered only for completing a Survey. You agree not to make any reward conditional on whether a respondent leaves a review, or on the rating or content of any review. You are responsible for complying with Google’s policies and applicable laws on reviews and advertising, including the rules of the U.S. Federal Trade Commission (FTC), where they apply to you.

AskHedgy acts solely as a technical facilitator and is not a party to any agreement between you and end users.

We do not:

  • guarantee reward delivery
  • verify legality, suitability, or quality of rewards
  • resolve disputes between you and respondents

All responsibility for rewards lies solely with you.

13. Fees and Payments

Some features require payment. Fees are displayed prior to purchase.

All fees are exclusive of taxes, including VAT. Where applicable, VAT may be applied in accordance with EU tax rules, including reverse charge mechanisms for VAT-registered business customers within the European Union.

Payments are processed via third-party payment providers. We are not responsible for errors caused by such providers.

Fees are generally non-refundable unless required by applicable law.

14. Prohibited Use

You agree not to use the Service for any unlawful, harmful, or abusive purposes.

You must not:

  • violate applicable laws, including GDPR
  • send spam or misleading communications, including unsolicited messages containing Review Kit links
  • attempt unauthorized access to systems or accounts
  • disrupt or interfere with the Service
  • reverse engineer or extract source code
  • distribute malicious software
  • misrepresent your identity or purpose
  • create fake reviews, solicit them, or post reviews on behalf of others
  • offer rewards for reviews or for positive review content
  • ask for reviews only from customers expected to leave positive ones, or discourage negative reviews
  • use the Service in violation of Google’s review policies

We reserve the right to suspend or terminate access for violations.

15. Termination

We may suspend or terminate access to the Service at any time if we reasonably believe you have violated these Terms or used the Service in a harmful manner.

You may stop using the Service at any time.

Upon termination, access to the Service ceases immediately. We may retain certain data where required or permitted by law.

Data processing and retention practices are further described in our Privacy Policy.

16. Intellectual Property

All rights in the Service, including software, design, features, and branding, remain the property of AskHedgy.

You are granted a limited, non-exclusive, non-transferable right to use the Service for internal business purposes.

You retain ownership of your content but grant us a limited license to process it solely to operate, maintain, and improve the Service.

17. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind.

We disclaim all warranties, including fitness for a particular purpose, reliability, accuracy, and uninterrupted operation.

18. Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages, including loss of profit, data, or business opportunities.

Our total liability is limited to the total amount paid by you for the Service in the six (6) months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability where such exclusion is not permitted under applicable law, including mandatory provisions of Lithuanian or EU law.

19. Indemnification

You agree to indemnify and hold harmless AskHedgy from any claims, damages, losses, or expenses arising from:

  • your use of the Service
  • your content, Review Kits, or Surveys
  • messages you send to your customers, including messages containing Review Kit links
  • violation of laws or these Terms
  • infringement of third-party rights

20. Governing Law

These Terms are governed by the laws of Lithuania.

Mandatory provisions of EU law, including the General Data Protection Regulation, apply where relevant.

Disputes shall be resolved in the competent courts of Lithuania, unless otherwise required by mandatory law.

21. Changes to Terms

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.

22. Entire Agreement

These Terms constitute the entire agreement between you and AskHedgy regarding the Service.

23. Severability

If any provision of these Terms is found invalid, the remaining provisions remain in full force and effect.

24. Communications

These communications form an integral part of the Service and are necessary for its operation and for the performance of the contract between you and AskHedgy.

24.1 System Communications

We may send you essential operational messages, including security alerts, account updates, and system notifications necessary for the functioning of the Service.

24.2 Billing Communications

We may send you invoices, payment confirmations, subscription updates, renewal notices, and pricing-related information required for contract and payment processing.

24.3 Product Updates & Educational Content

We may send you optional messages including product updates, feature announcements, blog posts, and educational content designed to help you use and understand the Service.

Where required by applicable law, such communications will only be sent based on your consent or our legitimate interest.

You may opt out of receiving these optional communications at any time without affecting essential service or billing communications.
